The article analyzes three different cases of clinical research in which children are asked to participate. Participation of children in researches is one of the major challenges for Bioethics and societies nowadays due to the tensions and issues concerning the guarantee of rights in clinical research, the responsibilities of the different actors involved, and the purpose of improving the quality of life without affecting scientific freedom and new knowledge production. The aim of the article is to establish the way in (...) which autonomy is exercised, considering ethical and regulative aspects within clinical research involving children. In order to achieve such a purpose, case study research methodology is employed, revealing the tensions and ethical issues involved in this particular kind of clinical research as well as considering international documents and the national regulation regarding this particular problem. Este artículo se centra en el reto que representa para los juzgadores valorar la confiabilidad de la prueba científica, dado que su naturaleza excede el conocimiento de la mayoría de ellos. Evaluar la confiabilidad y corrección de la prueba científica para asignarle un peso específico en el acervo probatorio es una labor para la que el (...) juez requiere de un análisis multidisciplinario. A manera de guía para el juzgador y como una herramienta innovadora en el ambiente judicial latinoamericano, se proponen lineamientos generales y específicos a seguir en la valoración de la confiabilidad de la prueba en tres áreas forenses. Los efectos derivados de este análisis serán contrastados con algunas perspectivas críticas sobre la (dis)capacidad y el capacitismo con el fin de cuestionar las posturas kantianas (...) y mostrar la productividad filosófica de una aproximación anacrónica que pone en contacto la historia de la filosofía en Occidente con el presente problemático que vivimos. Then he considers some topics in regard of the flowing of consciousness into experience concerning the forming of an individual’s personal identity. This topic has, as a background, the problem of the human experience of time and the phenomenological constitution of the internal consciousness of time. The hypothesis that it develops, following her, has to do with the possibility of showing how the original flowing of the living present is a required condition, but not enough, for the development of a person and his or her own identity. Las piedras pueden ser usadas para marcar recorridos y rutas para el pensamiento. Este itinerario está compuesto por cuatro piedras que configuran un terreno de contrastes. La primera pone el contraste entre lo vivo y lo no vivo como punto de partida en el cual la delicada interfaz entre esos dos mundos queda suspendida y puesta en entredicho. Aquí emerge el concepto de agencia como aspecto confuso y problemático. La segunda piedra se desplaza al contraste entre la construcción humana y (...) la construcción geológica, las cuales se encuentran unidas por diferentes acepciones de lo tectónico. El poder móvil de las piedras afinca la tercera piedra en la cual se presentan concepciones ‘premodernas’ del ingenio del paisaje en la geografía y una de las manifestaciones de la productividad de las piedras en los minerales. La extracción de estos últimos pone de manifiesto la íntima relación que hay entre las piedras y la discriminación sobre ciertos grupos humanos, de modo que la cuarta piedra expone la paradoja que se cierne sobre el contraste entre lo interior y lo exterior. Esta última piedra regresa sobre el concepto de agencia para enfatizar uno de sus rasgos turbios. Cada una de las piedras envuelve intersticios entre los cuales fluye una forma de pensamiento que bien podría llamarse la de una ontología minúscula. (shrink)

The demonstrations of monks in Tibet and Myanmar (Burma) in recent times as well as the age-old conflict between a predominantly Buddhist population and a Hindu minority in Sri Lanka raise the question of how the issues of human rights and Buddhism are related. The question applies both to the violation of basic rights in Buddhist countries and to the defence of those rights which are well-grounded in Buddhist teachings. From the theory of ‘deliberative democracy’ to the politics of the ‘third way’, the present Zeitgeist is characterized by attempts to deny what Chantal Mouffe contends is the inherently conflictual nature of democratic politics. Far from being signs of progress, such ideas constitute a serious threat to democratic institutions. Taking issue with John Rawls and Jürgen Habermas on one side, and the political tenets of Blair, Clinton and Schröder on the other, Mouffe brings to the fore the paradoxical nature (...) of modern liberal democracy in which the category of the ‘adversary’ plays a central role. She draws on the work of Wittgenstein, Derrida, and the provocative theses of Carl Schmitt, to propose a new understanding of democracy which acknowledges the ineradicability of antagonism in its workings. Chantal Mouffe is one of the most influential political theorists at work today. Her work has influenced political parties across Europe and continues to inform the direction of left politics. In this work, Mouffe argues that liberal democracy misunderstands the problems of ethnic, religious and nationalist conflicts because of its inadequate conception of politics.

Data are lacking with regard to participants' perspectives on return of genetic research results to relatives, including after the participant's death. This paper reports descriptive results from 3,630 survey respondents: 464 participants in a pancreatic cancer biobank, 1,439 family registry participants, and 1,727 healthy individuals. Our findings indicate that most participants would feel obligated to share their results with blood relatives while alive and would want results to be shared with relatives after their death.

We show that all QE rings of prime power characteristic are constructed in a straightforward way out of three components: a filtered Boolean power of a finite field, a nilpotent Jacobson radical, and the ring Z p n or the Witt ring W 2 (F 4 ) (which is the characteristic four analogue of the Galois field with four elements).

Although Wittgenstein is often held co-responsible for the so-called death of man as it was pronounced in the course of the previous century, no detailed description of his alternative to the traditional or Cartesian account of human being has so far been available. By consulting several parts of Wittgenstein's later oeuvre, Subjectivity after Wittgenstein aims to fill this gap. However, it also contributes to the debate about the Cartesian subject and its demise by discussing the criticism that the rethinking of (...) subjectivity received, for it has been argued that the anti-Cartesian turn in continental philosophy has lead to a loss of a centre for both ethics and politics. By further exploring the implications of the Wittgensteinian account of human being, this book makes it clear that a non-Cartesian view on the subject is not necessarily ethically and politically inert. Moreover, it argues that ethical and political arguments should not automatically take precedence in a debate about the nature of man. (shrink)

Kant’s Copernican turn has been the subject of intense philosophical debate because of the central role it plays in his transcendental philosophy. The analogy that Kant depicts between his own proposal and Copernicus’s has received many and varied interpretations that focus either on Copernicus’s heliocentrism and scientific procedure or on the experimental character of Kant’s endeavor. In this paper, I gather and review some of these interpretations, especially those that have ap­peared since the beginning of the twentieth century, to show (...) the many disparate and often contradictory stances that the Copernican turn has elicited. Despite the controversies between the different interpretations, they all are follow ups and reinventions of the single philosophical event named the Copernican turn. This common origin allows me to advance a narrative that portrays that event as an experiment, following Hans-Jörg Rheinberger’s philosophy of experimentation. My position does not entail that an experiment such as Kant’s conforms to what a scientific experiment is, although their histories could be narrated using a similar conceptual framework. In the end, my argument advances an experimental reading of the history of philosophy. (shrink)

El presente artículo, permite evidenciar la configuración de subjetividades de algunos adolescentes a partir de la visibilización del dolor, en tanto son portadores de una historia que los ha afectado, ya que han sido protagonistas directos de situaciones de violencia en escenarios que reclaman justicia social, tanto para sus familias como para la comunidad donde se movilizan. Palabras clave: aislamiento, cohesión familiar, desarraigo, dolor y subjetividad.

Este artículo propone analizar comparativamente la guerra, el conflicto y la violencia, en Colombia y Guatemala, ya que han tomado formas específicas y el papel que el Estado ha jugado en ellos ha tenido también sus matices. También tratará sobre las diversas versiones del conflicto y las maneras de recordarlo.

Social entrepreneurship is perceived as a legitimate and innovative solution to social problems. Yet, when one looks at the literature one finds that the social problems that the SE movement seeks to address and how these problems are identified and defined are not studied. This lack of attention to the defining of social problems in SE has implications for the domain for problems do not exist unless they are recognized and defined, and those that define problems have influence on how (...) these will eventually be addressed. Our paper presents an analysis of framing activities in SE done by the actors involved in the development and promotion of the SE movement. Our analysis reveals that these actors are concerned with creating an ecosystem to support social entrepreneurs. Critical analysis of discourses of these actors reveals a powerful mobilization discourse, one that supports social entrepreneurs as the agents of change. We also find that as the SE movement emerged at the beginning of a cycle of protest against capitalist systems, their framing of SE as system changing of these very systems therefore finds strong resonance with a wide variety of actors. L'auteure montre d'abord que la responsabilité des magistrats ne peut être dissociée de leur indépendance et de leur protection. Elle expose ensuite les différentes mesures de renforcement de la déontologie mises en place par le Conseil supérieur de la magistrature et la Cour de cassation. Elle conclut en rappelant que la responsabilité du juge est intérieure et prend sa source dans un travail du juge sur lui-même.

A significant part of Wittgenstein's later writings deal with psychological phenomena. Again and again he tries to show that thoughts, feelings, etc., cannot be understoodas objects or processes in some private inner realm. According to Wittgenstein the souldoes not reside inside of us, but should rather be located in between of us. Thus offering a new way of portraying several dichotomies (such as those between the inner and the outer, the public and the private, and the self and the other), (...) Wittgenstein can be said to rethink our concept of the subject. Or should we rather say that he proposes to reduce the soul to the body, the personal to the communal — in other words, that he in fact tries to 'unthink' subjectivity? To answer this question, this article confronts Wittgenstein's 'psychology' with his 'theology'. For contrary to what he writes on the psyche, Wittgenstein stresses in his writings on religion the individual instead of the collective and the private instead of the public. By showing that Wittgenstein's theology is actually compatible with his psychology, it is argued that Wittgenstein cannot besaid to proclaim the 'death' of the subject. (shrink)

Although Wittgenstein is famously skeptical about the possibility of making substantial philosophical claims, he can be said to offer significant insights into the difference between inner and outer as well as the difference between self and other.1 He consistently reminds us that inner and outer are intimately connected instead of only causally related, as well as that the self—far from being a wholly independent entity—always already finds itself constituted by its relationships with others. In thus contesting the Cartesian view on (...) subjectivity, however, Wittgenstein may appear to simply reduce the inner to the outer and the self to the other.. (shrink)

La démocratie est décriée ou dégradée, et l'autocratie nommément défendue, en Chine et à Singapour, dans certains pays musulmans, en Russie. Des deux côtés fleurissent les excès. En Occident, l'humanisme classique transformé en humanitarisme. En face, des cultures parfois devenues des idéologisations de leurs traditions. La religion, qui a irrigué la culture occidentale pendant deux mille ans, perd son influence sur tous les plans. La chrétienté ne se retire pas seule, mais avec elle ses fruits sécularisés, qui constituaient une architecture signifiante. Ces sagesses se nourrissent de renoncement, lequel forme aujourd'hui l'essentielle disposition de notre esprit. Renoncement à la quête de la vérité, renoncement au progrès, à la royauté de l'homme, à la liberté personnelle. Les conséquences en sont, par un lent processus, le remplacement du vrai par le bien, des dogmes par vies mythe, du temps fléché par un retour au temps circulaire, du monothéisme par le paganisme ou le panthéisme, de l'humanisme de liberté par un humanisme de protection, de la démocratie par le consensus, de la ferveur par le lâcher prise. C'est une métamorphose radicale, et ce renoncement est un retournement, non seulement de nos pensées, mais aussi de nos modes d'être et de nos institutions. Après une histoire de deux mille ans, sous de multiples signes réapparaît l'appel à une résignation sereine dont les hommes sans Dieu n'ont jamais cessé de rêver. (shrink)

L'ouvrage présenté ici a pour but de faire connaître la philosophie de Simone Weil, ainsi que les différentes facettes de son personnage, si lié à l'oeuvre elle-même. Les différents contributeurs auxquels nous avons fait appel sont tous des spécialistes de la philosophe, de plusieurs nationalités, et les plus éminents y figurent. Les responsables des Cahiers Simone Weil y sont naturellement bien représentés. Les aspects divers de la pensée de Simone Weil ont été ordonnés de façon à commencer par le coeur (...) – la philosophie – pour aller ensuite à la morale puis à la politique et à l'histoire, et enfin à l'approfondissement religieux et mystique. Les derniers chapitres insistent sur quelques perspectives plus particulières. Nous espérons ainsi offrir au lecteur un aperçu à la fois riche et pluriel de celle qui fut l'une des grandes philosophes du XXe siècle français. (shrink)

Nous sommes des êtres de chair, mais cette évidence s'obscurcit dès qu'il est question de déterminer l'étendue des aptitudes du corps et la nature de ses rapports avec l'esprit. Que peut au juste le corps? Telle est l'interrogation qui sous-tend depuis longtemps la réflexion philosophique et qui rend nécessaire aujourd'hui encore l'élaboration d'un " Connais-toi toi-même " corporel. Il importe alors d'examiner le corps à l'œuvre et d'explorer les diverses facettes de la corporéité pour en montrer la prodigieuse puissance. A (...) cet effet, il convient d'abord de cerner l'essence et la sphère d'extension de ce concept en épousant le mouvement qui, de l'inerte au vivant, des corps bruts au corps humain, préside à la constitution des multiples formes corporelles. Il s'agit ensuite de mesurer la puissance du corps à l'aune de ses capacités pratiques : puissance technique du corps en travail et au travail, puissance artistique et éthique du corps promoteur de valeurs, puissance sexuelle enfin qui nous enseigne de manière problématique aussi bien la différence entre nous et nous-mêmes - tant nous ne sommes pas ce que nous croyons être - que la différence entre le masculin et le féminin. Cet ouvrage est tout autant une méditation et une synthèse philosophiques qu'un hymne à la joie du corps. (shrink)

The purpose of this study is exposition on the themes of method and mysticism in the work of Simone Weil. Nearly a decade before the onset of her first mystical experience, Weil developed a method to be rigorously applied in daily philosophical reflection. She outlines this method in her dissertation on Descartes (1929-1930). I examine the question of how Weil applied method to philosophical reflection on her mystical experiences (onset 1938-1939). I analyze Weil’s mystical experiences as a type of transformative (...) experience in L. A. Paul’s strict sense of the term. On Paul’s view, an experience is transformative if it is both epistemically and personally transformative. An experience is epistemically transformative if the only way to know what it is like to have it is to have it yourself. An experience is personally transformative if it changes your point of view, including your core preferences (Paul, 2014). I present a thought experiment and textual evidence to motivate the claim that Weil’s mystical experiences meet Paul’s conditions for transformative experience. I then propose two epistemological facts that can be revealed by philosophical reflection on mystical experience. First, it is possible to read meaning erroneously in the appearances of things. Second, it is possible to come to hold to the certainty of a conviction for reasons that elude the intellect. My findings suggest that Weil’s late views on philosophy accommodate these two epistemological constraints, thereby demonstrating a possible connection between Weil’s mystical experiences and her mature views on the nature, scope, and proper method of philosophy. However, my preliminary findings also suggest that Weil’s early work on method may have anticipated these epistemological obstacles prior to the onset of her first mystical experience. Thus, further exposition of Weil’s method is needed to support or elucidate the claim (Rozelle-Stone and Davis, 2021) that Weil’s epistemology underwent significant changes because of her mystical experiences.
